1. General Provisions
1.1. This document is an official public offer by Fixlaptop (hereinafter referred to as the “Seller”) to conclude a distance sales agreement with any individual or legal entity (hereinafter referred to as the “Buyer”) through the online store available at: fixlaptop.ge.
1.2. According to Article 329 of the Civil Code of Georgia, acceptance of this offer is equivalent to entering into a legally binding contract.
2. Subject of the Agreement
2.1. The Seller agrees to transfer ownership of the goods presented in the online store catalog to the Buyer, and the Buyer agrees to pay for and accept the goods under the terms of this Agreement.
3. Moment of Agreement Conclusion
3.1. This Agreement is deemed concluded once the Seller confirms the Buyer’s order, submitted through the website, messaging apps, by phone, or email.
3.2. By placing an order, the Buyer agrees to this Offer, the Website Terms & Conditions, the Privacy Policy, and the Return & Warranty Policy.
4. Price and Payment Terms
4.1. The product price is determined by the online store at the time of order placement.
4.2. Payment is made based on the invoice issued or as otherwise agreed with the manager.
4.3. The goods are shipped only after full payment is received unless otherwise agreed for pre-order items.
5. Delivery of Goods
5.1. Delivery terms, costs, and timeframes are specified and agreed upon with the Buyer during order confirmation.
5.2. Delivery is a separate service and is paid additionally unless otherwise agreed by both parties.
6. Warranty and Returns
6.1. Warranty periods and return conditions are governed by the Return & Warranty Policy available on the Seller’s website.
6.2. By placing an order, the Buyer confirms their acceptance of the return and warranty terms.
7. Rights and Obligations of the Parties
The Seller undertakes to:
- Provide the Buyer with goods that meet the description and specifications;
- Provide accurate information about the goods, payment, and delivery;
- Comply with warranty and storage requirements.
The Buyer undertakes to:
- Pay for the ordered goods in full;
- Provide accurate information required for order processing and delivery;
- Read and agree to this Offer and the related policies published on the website.
8. Liability of the Parties
8.1. The Parties are liable for non-fulfillment or improper fulfillment of the terms of this Agreement in accordance with Georgian law.
8.2. The Seller is not liable for order fulfillment failures due to reasons beyond their control (force majeure, third-party actions, inaccurate Buyer data).
9. Dispute Resolution
9.1. All disputes shall be resolved through negotiations.
9.2. If no agreement is reached, disputes shall be resolved in accordance with the laws of Georgia.
10. Validity of the Offer
10.1. This public offer is valid indefinitely while it is published on the Seller’s website.
10.2. The Seller reserves the right to amend the terms of this Offer without prior notice to the Buyer.
